THIS SECOND EXTENSION FOR NATURAL AREAS AND EXOTIC VEGETATION <br />MANAGEMENT/MOWING AGREEMENT BETWEEN INDIAN RIVER COUNTY AND <br />JOHN BROWN & SONS, INC. (`CONTRACTOR"),' <br />THIS SECOND EXTENSION to Natural Areas and Exotic Vegetation Management/Mowing <br />Agreement is by and between Indian River County, a Political Subdivision of the State of Florida <br />("County") and John Brown and Sons, Inc., ("Contractor"). COUNTY and CONTRACTOR, in <br />consideration of the mutual covenants hereinafter set forth, agree as follows: <br />RECITALS <br />WHEREAS, On January 8, 2019, COUNTY and CONTRACTOR entered into the Natural Areas <br />and Exotic Vegetation Management/Mowing Agreement (the "Agreement"); and <br />WHEREAS, On December 17, 2019, COUNTY and CONTRACTOR entered into the First Extension <br />of the Natural Areas and Exotic Vegetation Management/Mowing Agreement (the "Agreement"); and <br />WHEREAS, the extension term of the Agreement was for one year, beginning on January 8, <br />2020, and allows a second one year extension; and <br />WHEREAS, pursuant to the Agreement, the parties desire to extend the Agreement for an <br />additional one year period; and <br />WHEREAS, the requirements for an extension have been satisfied and, COUNTY and <br />CONTRACTOR desire to execute the second extension to the Agreement for the period January 8, 2021 <br />through January 7, 2022. <br />NOW, THEREFORE, in consideration of the foregoing, and other good and valuable consideration, the <br />receipt and sufficiency of which are hereby acknowledged, the COUNTY and CONTRACTOR agree as <br />follows: <br />1. The background recitals are true and correct and form a material part of this Second Extension. <br />2. The following terms are added to the agreement: <br />The following paragraph is added to ARTICLE 7 — CONTRACTOR'S REPRESENTATIONS: <br />7.01 J CONTRACTOR is registered with and will use the Department of Homeland Security's E -Verify <br />system (www.e-verify.gov) to confirm the employment eligibility of all newly hired employees for the <br />duration of this agreement, as required by Section 448.095, F.S. CONTRACTOR is also responsible for <br />obtaining proof of E -Verify registration and utilization for all subcontractors. <br />
