AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, FURTHER EXTENDING THE <br />DEADLINE BY FIVE (5) YEARS FOR THE PROVIDENCE POINTE PDTND <br />DEVELOPMENT PROJECT TO COMMENCE CONSTRUCTION OR HAVE THE ZONING <br />DESIGNATION REVERT TO THE SITE'S ORIGINAL (PRE -PLANNED DEVELOPMENT <br />APPROVAL) ZONING DESIGNATION(S); AND PROVIDING FOR AN EFFECTIVE <br />DATE. <br />WHEREAS, the Board of County Commissioners of Indian River County, Florida, approved the <br />Providence Pointe Planned Development Traditional Neighborhood Design (PDTND) project with a <br />requirement that the project site's PDTND zoning designation shall revert to the site's original zoning <br />designation(s) if project construction did not commence within seven (7) years; and <br />WHEREAS, the project owner/developer has requested that the Board grant a five (5) year <br />extension of the zoning reverter deadline; and <br />WHEREAS, the extension request was received prior to the zoning reverter deadline of August <br />20, 2020; and <br />WHEREAS, the Board finds it reasonable to retroactively extend the zoning reverter deadline; <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian <br />River County, Florida, that the zoning reverter deadline for the Providence Pointe PDTND project is <br />extended for a period of five (5) years with a new deadline of August 20, 2025 [revises Ordinance 2013- <br />011]. <br />This ordinance shall become effective upon filing with the Department of State. <br />This ordinance was advertised in the Indian River Press Journal on the 6`h day of September, 2020, for a <br />public hearing to be held on the 22"d day of September, 2020, at which time it was moved for adoption <br />by Commissioner , seconded by Commissioner , and adopted by the <br />following vote: <br />Chairman Susan Adams <br />Vice Chairman Joseph E.
