5/25/90(LEGAL)Reso2(VCk) <br />RESOLUTION NO. 90-15_ <br />A RESOLUTION OF INDIAN RIVER COUNTY, FLORIDA, <br />BY ITS BOARD OF COUNTY COMMISSIONERS, ON <br />BEHALF OF THE DEPARTMENT OF PUBLIC WORKS <br />ESTABLISHING CERTAIN FEES AND CHARGES FOR USE <br />OF COUNTY ROAD RIGHT OF WAY AND FOR OPEN <br />CUTTING OF PAVED COUNTY ROADS. <br />BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS <br />OF INDIAN RIVER COUNTY, FLORIDA, that the following rates, <br />fees, and charges be adopted by Indian River County: <br />1. As a condition of any permit by the County to a <br />party allowing open cutting of paved County roads, there <br />shall be a cash maintenance bond in favor of Indian River <br />County, valid for one year from the completion of the open <br />cutting, which would allow the County to draw upon the cash <br />bond to perform emergency repairs or overlays on the <br />restored cut. The cash bond shall be in the amount of <br />$1,000.00 per lane cut. <br />2. As a condition of any permit authorizing the use <br />of County road right of way by any nonfranchised private <br />user, there shall be collected a fee at the rate of $500.00 <br />per mile per year, prorated to quarter mile increments, and <br />with a minimum of a $125 annual charge, payable to the <br />County by the permit holder. The responsibility for <br />collecting and monitoring this fee collection shall be with <br />the Public Works Department. <br />3. The cash bond requirement in paragraph #1 above <br />and the user fee requirement in paragraph #2 above shall not <br />be interpreted to apply to driveway permits. <br />The resolution was moved for adoption by Commissioner <br />Scurlock _—, and the motion was seconded by Commissioner <br />__Wheeler____, and, upon being put to a vote, the vote was <br />as follows: <br />Chairman Carolyn K.
