5 / 2 4 / 9 0 (WGC {''"12) LEGAL (%VGC / nhm ) <br />RESOLUTION 90 -_ZZ_ <br />RECORD VERIIFIED <br />JEFFREY, K.OARYON <br />CLERK C►RCUIT CGUR <br />INDIAN RIVER CO., FLA <br />A RESOLUTION OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLOR I DA, VACATING THE PLAT OF <br />WHISTLEWOOD SUBDIVISION. <br />WHEREAS, Whistlewood Subdivision has been platted <br />pursuant to Florida Statute Chapter 177, as laid out and as <br />recorded In Plat Book 10, Page 45, Public Records of Indian <br />River County, Florida; and <br />WHEREAS, Ty Tarby, Trustee, the fee simple owner <br />of Whistlewood Subdivision, has petitioned for vacation of <br />said plat, returning that plat to acreage; and <br />WHEREAS, the entire plat of Whistlewood <br />Subdivision is included in the Petition to Vacate; and <br />WHEREAS, no other persons own any other part of <br />the platted subdivision; and <br />WHEREAS, notice of the intention to apply to the <br />Board of County Commissioners of Indian River for vacation <br />of said plat has been published as a legal notice in a <br />newspaper of general circulation in Indian River County in <br />not less than two weekly issues of said paper; and <br />JO WHEREAS, proof of said publication of the notice <br />of intent to apply for vacation is attached hereto; and <br />WHEREAS, certificates from the Tax Collector <br />showing that all state and county taxes have been paid on <br />c the property are attached hereto, <br />v NOW, THEREFORE, BE IT RESOLVED by the Board of <br />40 <br />,1 County Commissioners of Indian River County, Florida, that: <br />1. All the above recitals are true and affirmed. <br />2. The entire plat of Whistlewood Subdivision, <br />including Lots 1 -• 6 and Whistlewood Lane as shown recorded <br />in Plat Book 10, Page 45, Public Records of Indian River <br />County, Florida is hereby returned to acreage. <br />1 <br />
