BooK 95 PAu 253 <br />ORDINANCE 95-10 <br />15. Staff -Level Approval of Certain Administrative Permits. <br />A. Section 971.04 is hereby amended to read as follows: <br />Section 971.04. Review of <br />administrative permit. <br />ra <br />uses requiring an <br />strative permit uses re( <br />'ommission a <br />irina Planni <br />®(a) Purpose and intent. This section is established <br />to provide for the approval of administrative permits by <br />the planning and zoning commission. Administrative <br />permit approval is required for certain activities which, <br />because of their scale, duration or nature, would not <br />generally have an adverse impact on their surroundings <br />when regulated in accord with the standards set in this <br />chapter. Unless otherwise specified in Sections 971.07- <br />971.45 for particular uses, administrative permit <br />requests shall be reviewed for approval by the Planning <br />and Zoninq Commission. <br />®(b) Establishment of uses requiring administrative <br />permits. The district regulations of Chapter 911, <br />Zoning, specify those uses which require an <br />administrative permit. Such uses shall be permitted only <br />after being approved pursuant to the procedures <br />established in this section and only after satisfying the <br />specific use criteria established in this chapter. <br />=(c) Authorization. The planning and zoning <br />commission is hereby authorized to decide all <br />applications for administrative permits, as set forth in <br />these provisions, subsequent to a recommendation by the <br />community development director. <br />®(d) Conditions and safeguards. The planning and <br />zoning commission may attach to its approval of an <br />administrative permit any reasonable conditions, <br />limitations or requirements which are found necessary in <br />its judgement to effectuate the purposes of this section <br />and carry out the spirit and purpose of the chapter. <br />®(e) Procedures for review of uses requiring <br />administrative permits. Uses requiring an administrative <br />permit shall be reviewed by the planning and zoning <br />commission, pursuant to the procedures and notice <br />requirements established in Chapter 914, Site Plans. <br />• f Standards. No administrative permit shall be <br />approved by the planning and zoning commission unless: <br />M1. Specific requirements. The proposal is <br />in compliance with all applicable <br />specific land use regulations of Chapter <br />971 and all other applicable regulations. <br />[M2. Comprehensive Plan. The proposal is <br />determined by to be consistent with the <br />Indian River County Comprehensive Plan. <br />M(q) Status —of decisions. Actions taken by the <br />planning and zoning commission regarding administrative <br />permits shall be deemed final unless appealed to the <br />board of county commissioners, pursuant to the site plan <br />appeal procedures of Chapter M 914. <br />36 <br />MAY 319 1995 <br />M <br />M <br />_I <br />
