BOOK 95 PAGE 259 <br />ORDINANCE 95-10 <br />2. In cases where a single-family unit is <br />being used in conjunction with a <br />business, the total area of the residence <br />may exceed the total area of the <br />business. No dwelling unit shall have <br />street frontage on the ground floor. <br />I. Section 971.41(7) is hereby amended to read as follows: <br />(7) Single-family docks constructed prior to the <br />construction of a princi al sin le -family dwelling unit <br />(administrative permit and special exception)no <br />Planning and Zoning Commission review or approval <br />required if associated with a site plan reviewed as an <br />administrative approval or minor site plan). <br />(a) The construction of a single-family dock on a <br />lot prior to the construction of a principal <br />single-family dwelling unit on the same lot <br />shall be permitted for the purpose of <br />providing waterfront property owners vested <br />riparian rights for access to the adjacent <br />waterbody. <br />The aforementioned dock, however, shall <br />continue to be construed as an accessory <br />structure and its use prior to the issuance of <br />a certificate of occupancy for the principal <br />structure shall not be considered consistent <br />with the appropriate zoning district <br />regulations. <br />(b) Districts requiring administrative permit <br />approval, (pursuant to the provisions of <br />971.04): A-1, A-2, A-3, RFD, RS -1, RS -2, RS - <br />3, RS -61 RT -6, RM -3, RM -4, RM -6, RM -81 RM -10. <br />(c) Districts requiring special exception <br />approval, (pursuant to the provisions of <br />971.05): Con -2, Con -3. <br />(d) Additional information requirements: <br />1. A site plan showing the dimensions, <br />elevations and location of the dock <br />structure; <br />2. All applicable local, state, and federal <br />permits and/or leases or consent of use <br />agreements shall be submitted to the <br />planning division prior to release of the <br />dock site plan. <br />(e) Criteria for single-family docks constructed <br />prior to the construction of a principal <br />single-family unit: <br />1. The owner shall submit and record in the <br />public records of Indian River County an <br />agreement that the dock will not be used <br />until such time as a certificate of <br />occupancy for the principal single-family <br />unit is issued by the county; <br />MAY 319 1995 <br />M M M <br />
