Per guidelines established by the Board of County Commissioners, <br />the petition was reviewed by all county divisions and utility <br />providers having jurisdiction or potential interests within the <br />right-of-way. All reviewing agencies and departments have <br />recommended approval of the requested abandonment, with the <br />reservation of an easement for utilities and drainage. This right- <br />of-way is not part of the roadway system as noted on the County <br />Thoroughfare Plan, and is not needed for the thoroughfare system. <br />The abandonment would not affect the right of convenient access to <br />the subject property or to surrounding properties. Also, the <br />County Attorney's Office has reviewed and approved the attached <br />abandonment resolution for legal form and sufficiency. <br />RECOMMENDATION: <br />Based on the analysis, staff recommends that the Board of County <br />Commissioners: <br />1. Abandon its rights to the subject 5' right-of-way strip, with <br />the condition that a drainage and utilities easement be <br />executed by the applicant for the 5' strip prior to recording <br />the resolution, and <br />2. Authorize the chairman of the Board of County Commissioners to <br />execute the attached abandonment resolution. <br />The Chairman opened the Public Hearing and asked if anyone <br />wished to be heard in this matter. There being none, he closed the <br />Public Hearing. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams, the Board unanimously approved <br />staff's recommendation as set out in the above memo <br />and adopted Resolution 95-65, providing for the <br />closing, abandonment, vacation and discontinuance of <br />a portion of 47th Street between 39th Avenue and <br />40th Avenue said land lying in Indian River County, <br />FL. <br />June, 6 1995 <br />I <br />
