ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams, the Board unanimously scheduled <br />a public hearing for June 27, 1995 to consider <br />adoption of a proposed ordinance on limitation of <br />waiver of immunity. <br />D. Set Public Hearing for Ordinance on Occupational License Tax <br />The Board reviewed the following memo dated 5/30/95: <br />TO: Board of County Commissioners <br />FROM: Terrence P. O'Brien - Assistant County Attorney <br />DATE: May 30, 1995 <br />SUBJECT: OCCUPATIONAL LICENSE TAX <br />The County enacted Ordinance No. 95-4 which established a single <br />occupational license tax classification for all businesses. This ordinance <br />has an effective date of August 1, 1995. It appears that the public <br />notice for this ordinance may not have met the specificity required by <br />Section 205.032, F.S. This section requires that the public notice <br />contain the "proposed classification and rates applicable to the <br />occupational license tax." Rather than face a possible challenge at a <br />later date, it is felt that this matter should be corrected by enacting a <br />new ordinance with proper notice. <br />The proposed amendments are identical to those adopted in Ordinance <br />95-4 with the exception of a new requirement for flea markets set <br />forth in Section 207.11. <br />The Tax Collector recently made a weekend sweep of major flea markets <br />to look for violations of the occupation license tax ordinance. As a <br />result of that sweep, the Tax Collector felt that a revision to the <br />ordinance would facilitate enforcement.
