MEMORANDUM <br />TO: Board of County Commissioners <br />FROM: Dylan Reingold, County Attorney <br />DATE: October 9, 2020 <br />SUBJECT: Ford F -Series Door Latch Class Action Settlement <br />(Brandon Kommer v. Ford Motor Company) <br />Case No. 1:17-cv-00296-LEK-DJS (N.D. NY) <br />BACKGROUND. <br />The above -referenced litigation involves a suit against Ford Motor Company alleging that the door latches <br />in certain model year 2015 — 2019 Ford F -Series trucks ("Class Vehicles") have a design defect that <br />causes the door latch to malfunction. <br />By November 2, 2020, the Indian River County Board of County Commissioners ("Board") has to decide <br />whether to opt out of the settlement. No action is required in order to stay in the settlement class. If the <br />Board decides to stay in the settlement class, the County will have until November 30, 2020 to file a <br />claim. The Board also has the right to file an objection to the proposed settlement by November 2, 2020. <br />If the Board decides to stay in the settlement class, the Board will relinquish its right to file a lawsuit <br />concerning the issues and claims at stake in the litigation. <br />FUNDING. <br />There is no funding associated with this item if the Board decides to stay in the settlement class and file a <br />claim if entitled to do so. <br />RECOMMENDATION. <br />The County Attorney's Office recommends that the Board vote to stay in the settlement class and file a <br />claim if entitled to do so. <br />ATTACHMENT(S). <br />Notice of Class Action Settlement <br />86 <br />
