RENEWAL OF AGREEMENT FOR FOOD CONCESSION SERVICES AND LEASE BETWEEN INDIAN RIVER COUNTY AND DI'MICHELLI'S CATERING, INC. This Renewal of Agreement for Food Concession Services and Lease Between Indian River County and Di'Michelli's Catering, Inc. ("Renewal") is entered into this 2nd day of March, 2021 ("Effective Date"), by and between Indian River County ("County"), whose address is 1801 27th Street, Building A, Vero Beach, FL, 32960, and Di'Michelli's Catering, Inc., a Florida corporation whose address is 857 South Kings Highway, Ft. Pierce, FL, 34949 (the "Concessionaire"). WHEREAS, County and Concessionaire entered into the Agreement for Food Concession Services and Lease Between Indian River County and Di'Michelli's Catering, Inc., (the "Agreement") which commenced on April 1, 2015; and WHEREAS, on December 12, 2017, an Assumption and Joinder to Agreement for Food Concession Services and Lease at Sandridge Golf Club was entered into; and WHEREAS, the Agreement was renewed for a one-year term commencing on April 1, 2020 until March 31, 2021; and WHEREAS, the Agreement can be renewed for successive one year terms for a maximum of ten years; and WHEREAS, County and Concessionaire desire to renew the Agreement for one year, until March 31, 2022, under the terms as set forth in the Agreement; and NOW THEREFORE, in consideration of the premises and other good and valuable consideration, the receipt whereof is hereby acknowledged, the parties agree as follows: 1. The recitals are true and correct and are adopted by reference herein. 2. The Agreement is renewed until March 31, 2022, unless otherwise terminated as set forth in the Agreement. 3. All other terms and conditions of the Agreement shall remain unchanged. IN WITNESS WHEREOF, the parties have executed this Renewal of Agreement for Food Concession Services and Lease Between Indian River County and Di'Michelli's Catering, Inc. as of the day and year first written above. 1
