<br />LICENSED PRODUCTS. The term that collectively refers to any tobacco, tobacco -related
<br />device, nicotine dispensing devices or nicotine products..
<br />LOOSIES. The common term used to refer to single or individually packaged cigars or cigarettes,.
<br />or any other licensed product that has been removed from its intended retail packaging and
<br />offered for sale. LOOSIES does not include individual cigars with a retail price, after any
<br />discounts are applied and before any sales taxes are imposed, of at least [ $4.00 ] per cigar.
<br />MOVEABLE PLACE OF BUSINESS. Any form of business that is operated out of a kiosk, truck,
<br />van, automobile or other type of vehicle or transportable shelter and not a fixed address store
<br />front or other permanent type of structure authorized for sales transactions.
<br />NICOTINE DISPENSING DEVICE. Any product that employs an electronic, chemical, or
<br />mechanical means to produce vapor from a nicotine product, including, but not limited to, an
<br />electronic cigarette, electronic cigar, electronic cigarillo, electronic pipe, or other similar device
<br />or product, any replacement cartridge for such device, and any other container of nicotine in
<br />a solution or other form intended to be used with or within an electronic cigarette, electronic
<br />cigar, electronic cigarillo; electronic pipe, or other similar device or product.3
<br />NICOTINE PRODUCT. Any product that contains nicotine, including liquid nicotine, that is
<br />intended for human consumption, whether inhaled, chewed, absorbed, dissolved, or ingested
<br />by any means, but.does not include a:
<br />(1) Tobacco product;
<br />(2) Product regulated as a drug or device by the United States Food and Drug
<br />Administration under Chapter V of the federal Food, Drug, and Cosmetic Act; or
<br />(3) Product that contains incidental nicotine
<br />PERSON. Any natural person, partnership, joint venture, society, club, trustee, trust,
<br />association, organization, or corporation, or any officer, agent, employee, factor, or any other
<br />personal representative thereof, in any capacity.
<br />PHARMACY. A place of business at which prescription drugs are prepared, compounded,
<br />or dispensed by or under the supervision of a pharmacist and from which related clinical
<br />pharmacy services are delivered.
<br />RETAIL ESTABLISHMENT. Any place of business where licensed products are available for sale
<br />to the general public. The phrase includes but is not limited to grocery stores, tobacco products
<br />shops, hookah lounges, convenience stores, gasoline service stations, bars, and restaurants.
