Matson, AICP <br />Community Development Director <br />THROUGH: Andrew Sobczak <br />Chief, Environmental Planning <br />& Code Enforcement <br />FROM: Kelly Buck <br />Code Enforcement Officer <br />DATE: 2/2/2021 <br />RE: Request for Release of an Easement Located at 11425 Old Dixie Highway <br />It is requested that the Board of County Commissioners formally consider the following information at its <br />regular meeting of February 16, 2021. <br />DESCRIPTION AND CONDITIONS <br />The County has been petitioned by Spirit of Sebastian, LLC, owner of a property located at 11425 Old <br />Dixie Highway, for release of a f.62 acre conservation easement. The purpose of the easement release is to <br />accommodate site improvements related to a planned residential development with approval through the <br />City of Sebastian. <br />ANALYSIS <br />In 1996, the subject f.62 acre conservation easement was recorded as part of a County site plan approval <br />requirement for a proposed mining operation onsite. At that time, the subject property was located within <br />the unincorporated area of Indian River County. Since then, the mining operation has ended and the property <br />has been annexed into the City of Sebastian. <br />RECOMMENDATION <br />Staff recommends that the Board, through adoption of the proposed resolution, approve release of the <br />conservation easement described in the proposed resolution. <br />Attachments: <br />1.
