By complying with all requirements established by the Federal grantor agency to avoid or <br />mitigate adverse effects upon such properties. <br />i. Give the sponsoring agency or the Comptroller General, through any authorized representative, <br />access to and the right to examine all records, books, papers, or documents related to the grant. <br />j. With respect to demolition activities: <br />i. Create and make available documentation sufficient to demonstrate that the Subrecipient <br />and its demolition contractor have sufficient manpower and equipment to comply with the <br />obligations as outlined in this Agreement; <br />ii. Return the property to its natural state as though no improvements had been contained <br />thereon; <br />iii. Furnish documentation of all qualified personnel, licenses, and all equipment necessary <br />to inspect buildings located in Subrecipient's jurisdiction to detect the presence of <br />asbestos and lead in accordance with requirements of the U.S. Environmental Protection <br />Agency, the Florida Department of Environmental Protection, and the appropriate County <br />Health Department; <br />iv. Provide documentation of the inspection results for each structure to indicate safety <br />hazards present, health hazards present, and/or hazardous materials present; <br />v. Provide supervision over contractors or employees employed by the Subrecipient to <br />remove asbestos and lead from demolished or otherwise applicable structures; <br />vi. Leave the demolished site clean, level, and free of debris; <br />vii. Notify the Recipient promptly of any unusual existing condition which hampers the <br />contractors work; <br />viii. Obtain all required permits; <br />ix. Provide addresses and marked maps for each site where water wells and septic tanks <br />are to be closed, along with the number of wells and septic tanks located on each site, <br />and provide documentation of such closures; <br />x. Comply with mandatory standards and policies relating to energy efficiency which are <br />contained in the State energy conservation plan issued in compliance with the Energy <br />Policy and Conservation Act; <br />A. Comply with all applicable standards, orders, or requirements issued under Section 112 <br />and 306 of the Clean Air Act, Section 508 of the Clean Water Act, Executive Order 11738, <br />and the U.S. Environmental Protection Agency regulations. (This clause must be added <br />to any subcontracts); and, <br />xii. Provide documentation of public notices for demolition activities. <br />k. Require facilities to be designed to comply with the "American Standard Specifications for Making <br />Buildings and Facilities Accessible to, and Usable by the Physically Handicapped," Number <br />A117.1-1961, as modified. The Subrecipient will be responsible for conducting inspections to <br />ensure compliance with these specifications by the contractor. <br />L. Provide an Equal Employment Opportunity Program, if required to maintain one, where the <br />application is for $500,000.00 or more. <br />m. Return overpaid funds within the forty-five (45) day requirement, and if unable to pay within the <br />required time period, begin working with the Recipient in good faith to agree upon a repayment <br />date. <br />n. In the event a Federal or State court or Federal or State administrative agency makes a finding of <br />discrimination after a due process hearing on the Grounds of race, color, religion, national origin, <br />sex, or disability against a recipient of funds, forward a copy of the finding to the Office for Civil <br />Rights, Office of Justice Programs. <br />4) The Subrecipient agrees it will comply with the: <br />a. Requirements of all provisions of the Uniform Relocation Assistance and Real Property <br />Acquisitions Act of 1970 which provides for fair and equitable treatment of persons displaced as <br />a result of Federal and Federally assisted programs. <br />34 <br />
