SMITH, CLERK <br />If none of the above applies, the Subrecipient may request additional funding through small project netting, <br />known as the net small project overrun appeal. The request operates as a normal appeal, but includes all <br />of the Subrecipient's Small Projects. The Subrecipient must send its request to the Recipient's Appeals <br />Officer within sixty (60) days of completion of the work for the Subrecipient's last Small Project. The appeal <br />must include actual cost documentation for all Small Projects that FEMA originally funded based on <br />estimate amounts. FEMA will evaluate all Small Projects and make adjustments according to any overruns <br />or underruns for each project. FEMA will not consider requests submitted past the appeals deadline. <br />To ensure that all work has been performed within the SOW specified on the Project Worksheets (PW), the <br />Recipient will conduct final inspections on Large Projects, and may, at its sole discretion, select one or <br />more Small Projects to be inspected. Costs determined to be outside of the approved scope of work and/or <br />outside of the approved performance period cannot be reimbursed. <br />For Hurricane Isaias EM#E3533, projects that are under $131,100.00 are considered small projects. In <br />coordination with FEMA, the Division will accept a self -certification of small projects in lieu of project <br />documentation. The self -certification will require the applicant to certify that the scope of work is eligible <br />and that the funds will be expended in accordance with State and Federal law. <br />Once the project is obligated, the Division will reimburse the project without a request for reimbursement <br />5. TIME EXTENSIONS <br />FEMA only provides Public Assistance (PA) funding forwork completed and costs incurred within regulatory <br />deadlines. The deadline for Emergency Work is six (6) months from the declaration date. <br />If the Subrecipient determines it needs additional time to complete the project, including direct <br />administrative tasks related to the project, it must submit a written request for a Time Extension to the <br />Recipient with the following information: <br />• Documentation substantiating delays beyond its control; <br />• A detailed justification for the delay; <br />• Status of the work; and <br />• The project timeline with the projected completion date. <br />Within its discretion, set out by 44 C.F.R. §206.204, the Division may grant a time extension for Category <br />B (emergency protective measures) work. <br />FEMA has authority to extend individual project deadlines beyond these timeframes if extenuating <br />circumstances justify additional time. This applies to all projects with the exception of those projects for <br />temporary facilities. <br />FEMA generally considers the following to be extenuating circumstances beyond the Subrecipient's control: <br />• Permitting or Environmental and Historic Preservation (EHP) compliance related delays due to <br />other agencies involved; <br />• Environmental limitations (such as short construction window); <br />• Inclement weather (site access prohibited or adverse impact on construction); and <br />• Lack of availability of materials, equipment, or contractors to complete work. <br />FEMA generally considers the following to be circumstances within the control of the Subrecipient and not <br />justifiable for a time extension: <br />• Permitting or environmental delays due to Subrecipient delays in requesting permits; <br />• Lack of funding; <br />• Change in administration or cost accounting system; and/or <br />• Compilation of cost documentation. <br />Although FEMA only provides PA funding for work performed on or before the approved deadline, the <br />Subrecipient must still complete the approved SOW for funding to be eligible. FEMA de -obligates funding <br />for any project that the Subrecipient does not complete. If the Subrecipient completes a portion of the <br />approved SOW and the completed work is distinct from the uncompleted work, FEMA only de -obligates <br />funding for the uncompleted work. For example, if one project includes funds for three facilities and the <br />Subrecipient restores only two of the three facilities, FEMA only de -obligates the amount related to the <br />facility that the Subrecipient did not restore. <br />40 <br />
