A44;� <br />AND STAFFED ASSISTANT DIRECTOR OF UTILITY SERVICES <br />BY: DEPARTMENT OF UTILITY SERVICES <br />SUBJECT: COUNTRYSIDE MOBILE HOME PARK, RESOLUTION 185-61, <br />BETWEEN REALCOR ASSOCIATES AND INDIAN RIVER COUNTY <br />PUBLIC HEARING <br />BACKGROUND AND ANALYSIS <br />On May- 23, 1995, the Indian River County Board of County <br />Commissioners set the date of June 13, 1995 for the public hearing <br />of the above -referenced franchise. The information previously <br />submitted for review by the Board of County Commissioners is <br />attached. <br />RECOMMENDATION <br />The staff of the Department of Utility Services recommends that the <br />Board of County Commissioners find the franchise in default and, <br />therefore, the franchise is no longer in force. <br />Attorney Vitunac announced that back in 1985 the County gave <br />a, franchise to Realcor Corporation and apparently that park has <br />been sold to a new buyer. The sole purpose for this public meeting <br />today is to determine whether Realcor is in violation of its <br />franchise. The Utilities Department is prepared to present several <br />aspects of the franchise which they feel have not been complied <br />with. There are other aspects concerning Countryside and the <br />County, impact fees and overdue debts and the purchase of the park, <br />which are not truly part of the franchise discussion today. <br />Attorney Vitunac noted that Utilities Director Terry Pinto is <br />prepared to present the facts showing that all franchise <br />requirements have not been met. He also noted that there is an <br />attorney here representing the present owners of the park together <br />with representatives from both citizens' committees. With that, he <br />asked Director Pinto to present the charges. <br />Director Pinto explained that the Utilities Department is <br />charged with overseeing private franchises within Indian River <br />County. The issues today are payment of their 6% franchise fees, <br />keeping their R & R accounts current, and filing annual reports. <br />Since 1992, Realcor, the holder of the franchise, has failed to <br />comply with those terms of the franchise and there have been <br />JUNE 139 1995 80 Bou 95 PAGE 420 <br />
