SMITH, CLERK <br />arises from the desire to supplement the State - <br />Funded Grant Agreement ("Agreement") entered into and executed on May 22nd. 2019 as identified above. All provisions <br />in the Agreement and supplements, if any, remain in effect except as expressly modified by this Supplemental. <br />The parties agree that the Agreement is to be amended and supplemented as follows: <br />This Amendment extends the Term of the Agreement. <br />Paragraph 3 of the Agreement is amended to read as follows: <br />This Agreement shall commence upon full execution by both Parties and the Recipient shall complete the Project on or <br />before June 30, 2022. <br />This Amendment increases the total funding needed for the Construction and CEI Services of the Project by FIVE <br />MILLION THREE HUNDRED SIXTY SIX THOUSAND THREE HUNDRED SEVENTEEN DOLLARS AND NO CENTS <br />($5,366,317.00). <br />Paragraph 6a of the Agreement is amended to read as follows: <br />The estimated cost of the Project is $37,226,671.00. This amount is based upon the Schedule of Financial Assitance in <br />Exhibit "B", attached and incorporated into this Amendment. <br />Paragraph 6b of the Agreement is amended to read as follows: <br />The Department agrees to participate in the Project cost up to the maximum amount of $18,613,335.00 and, <br />additionally the Department's participation in the Project shall not exceed 50% of the total cost of the Project, and as <br />more fully described in Exhibit "B", Schedule of Financial Assistance. The Department's participation may be increased <br />or reduced upon a determination of the actual bid amounts of the Project by the execution of an amendment. The <br />Recipient agrees to bear all expenses in excess of the amount of the Department's participation and any cost overruns <br />or deficits incurred in connection with completion of the Project. <br />Pragraph 6c remains in full force and effect. <br />Reason for this Supplemental and supporting engineering and/or cost analysis: <br />The funding increase is due to the actual accepted bid being higher than the original cost estimate for Construction and <br />CEI services <br />
