Grantee shall have a continuing obligation to disclose, to the Commission, <br />in writing, if it, its principals, recipient, subrecipient, contractor, or subcontractor, are on the <br />convicted vendors list maintained by the Florida Department of Management Services pursuant to <br />Section 287.133(3)(d), F.S. <br />i. Convicted Vendor List. Pursuant to Subsection 287.133(2)(a), F.S., a person or affiliate <br />who has been placed on the convicted vendor list following a conviction for a public entity <br />crime may not be awarded or perform work as a Grantee, supplier, subcontractor or <br />consultant under a contract with any public entity and may not transact business with any <br />public entity in excess of the threshold amount provided in Section 287.017, F.S., for <br />Category Two for a period of thirty-six (36) months from the date of being placed on the <br />convicted vendor list. Notice of Conviction of Public Entity Crime. Any person must notify the Department <br />of Management Services and the Commission, in writing, within thirty (30) days after <br />conviction of a public entity crime applicable to that person or an affiliate of that person as <br />defined in Section 287.133, F.S. <br />C. Vendors on Scrutinized Companies List. <br />Scrutinized Companies. Grantee certifies that it and any of its affiliates are not <br />scrutinized companies as identified in Section 287.135, F.S. In addition, Grantee agrees <br />to observe the requirements of Section 287.135, F.S., for applicable sub -agreements <br />entered into for the performance of work under this Agreement. Pursuant to Section <br />287.135, F.S., the Commission may immediately terminate this Agreement for cause if <br />the Grantee, its affiliates, or its subcontractors are found to have submitted a false <br />certification; or if the Grantee, its affiliates, or its subcontractors are placed on any <br />applicable scrutinized companies list or engaged in prohibited contracting activity during <br />the term of the Agreement. As provided in Subsection 287.135(8), F.S., if federal law <br />ceases to authorize these contracting prohibitions then they shall become inoperative. <br />D. Discriminatory Vendors. Grantee shall disclose to the Commission, in writing, if they, their <br />subrecipient, contractor, or subcontractor, are on the Discriminatory Vendor List maintained by the <br />Florida Department of Management Services pursuant to Section 287.134(3)(d), F.S. "An entity or <br />affiliate who has been placed on the discriminatory vendor list may not submit a bid, proposal, or <br />reply on a contract to provide any goods or services to a public entity; may not submit a bid, <br />proposal, or reply on a contract with a public entity for the construction or repair of a public building <br />or public work; may not submit bids, proposals, or replies on leases of real property to a public <br />entity; may not be awarded or perform work as a contractor, supplier, subcontractor, or consultant <br />under a contract with any public entity; and may not transact business with any public entity." <br />Section 287.134(2)(a), F.S. Grantee has a continuing duty to disclose to the Commission whether <br />they appear on the discriminatory vendor list. <br />E. Prompt Disclosure of Litigation, Investigations, Arbitration, or Administrative Proceedings. <br />Throughout the term of the Agreement, the Grantee has a continuing duty to promptly disclose to <br />the Commission's Grant Manager, in writing, upon occurrence, all civil or criminal litigation, <br />GRANT - GOVERNMENTAL ENTITY.
