��L1( ) .493 <br />County Attorney Vitunac reported that he had spoken with Vero <br />Beach City Manager Tom Nason who was satisfied with the suggested <br />language change and County staff was also satisfied. He advised <br />that a representative from the Moorings and Vero Beach's City <br />Attorney were present for any comment or questions and, if the <br />Board wished, his office would put it in ordinance form. <br />Administrator Chandler advised that the suggested language <br />satisfied his concerns. <br />Dorothy Hudson, attorney for the Moorings, was quite impressed <br />with the drafted language and commended Attorney Vitunac for his <br />effort. <br />Chairman Macht commented on the fairness of the suggested plan <br />because everybody gets treated the same. <br />Commissioner Eggert asked the overall effect, and <br />Administrator Chandler advised -that when we provide re -use water, <br />the rate structure will not include a franchise fee. We haven't <br />yet established a rate structure for re -use, and it is difficult to <br />peg what those dollars might be. The feeling is that we need to be <br />careful and be uniform in how we approach it all. <br />Lawrence Braisted, City Attorney of Vero Beach, on behalf of <br />City Manager Tom Nason who could not be present, advised that they <br />support the proposed ordinance and are in agreement with the <br />proposed change, because they are trying to keep the cost of the <br />re -use to a minimal amount in order to encourage its use and less <br />use of the potable system. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams, the Board unanimously <br />approved the proposed language and directed <br />staff to bring it back in the form of an <br />ordinance. <br />Commissioner Tippin remarked that it was very refreshing to <br />see three attorneys in this room agreeing with each other. <br />46 <br />June 20, 1995 <br />
