ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams, the Board unanimously <br />adopted Resolution No. 95-73 releasing an <br />ingress -egress easement on property legally <br />described in the resolution, owned by Andrew <br />W. Edmonds, located at 8525 SR -60, and known <br />as Year Round Garden Center, as recommended in <br />the memorandum. <br />RESOLUTION NO: 95-73 <br />A RESOLUTION OF INDIAN RIVER COUNTY, FLORIDA <br />RELEASING AN INGRESS - EGRESS EASEMENT <br />WHEREAS, Indian River County has an easement as described <br />below; and <br />WHEREAS, the retention of this easement, except for the <br />eastern 25 feet of said easement, serves no public purpose; <br />NOW, THEREFORE, BE IT RESOLVED by the Board of County <br />Commissioners of Indian River County, Florida that: <br />This release of easement is executed by Indian River County, a <br />political subdivision of the State of Florida, whose mailing <br />address is 1840 25th Street, Vero Beach, Florida 32960, Grantor, to <br />Andrew W. Edmonds, his successors in interest, heirs and assigns, <br />whose mailing address is c/o William J. Stewart, Esq.; P.O. Box <br />3345, Vero Beach, Florida 32964, Grantee, as follows: <br />Indian River County does hereby abandon all right, title, and <br />interest that it may have in that portion of an ingress and egress <br />easement described as follows: <br />the north 40 feet, less and except the east 25 feet (of the <br />north 40 feet), of the following described parcel of land: the <br />west 165 feet of the east 895 feet of Tract 10, Section 2, <br />Township 33 South, Range 38 East, as recorded in O.R. Book <br />728, Page 1685 of the Public Records of Indian River County, <br />Florida, less road right-of-way, said land now lying and being <br />in Indian River County, Florida.
