• <br />INDIAN RIVER COUNTY, FLORIDA <br />MEMORANDUM <br />TO: Jason E. Brown, County Administrator <br />THROUGH: Richard B. Szpyrka, P.E., Public Works Director <br />FROM: James W. Public Works Director <br />SUBJECT: Florida Department of Transportation (FDOT) Right of Way Acquisition <br />Memorandum of Agreement for Oslo Rd from East of 82nd Avenue SW to 58th <br />Avenue SW, FDOT Financial Project No. 431521-1-52-01 (IRC -1411) <br />DATE: February 25, 2021 <br />DESCRIPTION AND CONDITIONS <br />The Florida Department of Transportation (FDOT) requires that Indian River County approve the attached <br />Right of Way Acquisition Memorandum of Agreement outlining conditions for the acquisition of certain <br />property rights along the project corridor of Oslo Road from East of 82nd Avenue SW to 58th Avenue SW. The <br />agreement endorses FDOT to perform the right of way acquisition, for and on behalf of the County. The <br />County authorizes FDOTto conduct right of way acquisition and related activities, including eminent domain <br />proceedings, on the project in accordance with the Federal Uniform Relocation Assistance and Real Property <br />Acquisition Policies Act of 1970, as amended. <br />FDOT is authorized to remove any unpermitted and/or unauthorized improvements or personal property <br />within the County right of way within the project limits. In the event an improvement or personal property is <br />permitted and/or authorized with the County right of way, the County shall cooperate with the FDOT to <br />coordinate its removal. Removal shall include, but is not limited to, notice of ejectment, eviction, etc. Upon <br />FDOT's completion of its acquisition activities, the County will accept the acquired property from the FDOT. <br />FUNDING <br />No funding is necessary for this item. <br />RECOMMENDATION <br />Staff recommends the Board of County Commissioners approve the Authorizing Resolution and FDOT Right <br />of Way Acquisition Memorandum of Agreement and authorize the Chairman to execute the same. <br />ATTACHMENTS <br />Authorizing Resolution <br />FDOT Right of Way Acquisition Memorandum of Agreement <br />AGENDA ITEM FOR MARCH 16, 2021 <br />55 <br />
