BOOK 95 FACE 569 <br />Phase I includes 57 single family lots at a density of 1.51 units <br />per acre, the golf course clubhouse tract, the maintenance building <br />tract, and conservation areas. The owner, Indian River Club, Ltd. <br />through its agent Masteller, Moler & Reed, Inc., is now requesting <br />final plat approval for Plat #1 (Phase I) and has submitted the <br />following: <br />1. A final plat in conformance with the approved preliminary <br />plat. <br />2. A certificate of completion for all required improvements <br />within the Plat #1 (Phase I) area. <br />3. A contract for construction for the remaining required <br />improvements with a letter of credit to guarantee <br />construction. <br />4. A warranty and maintenance agreement with a letter of credit <br />to secure the agreement. <br />ANALYSIS: <br />The majority of required improvements have been completed by the <br />developer and inspected by the public works and utilities <br />departments. The public works department has issued a certificate <br />of completion, indicating that all of the improvements that have <br />been completed are acceptable. There are several improvements <br />which are not complete, including a second layer of asphalt on the <br />internal project streets, pavement markings, and streetlights. The <br />public works department has approved a cost estimate for these <br />improvements and the attorney's office has approved the contract <br />for construction. With the exception of certain utility facilities <br />that will be dedicated to Indian River County, all improvements <br />within the Indian River Club will be private. Certain improvements <br />constructed in the public right-of-way such as turn lanes and <br />sidewalks are subject to a warranty and maintenance agreement. The <br />public works department has approved the cost estimate for 'these <br />items and the county attorney's office has approved the warranty <br />and maintenance agreement. Utilities improvements will be <br />warranted separately, via a Utilities Department bill of sale. <br />Therefore, all final plat requirements for Plat #1 (Phase I) have <br />been satisfied. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners grant final <br />plat approval for Plat #1 (Phase I) of the Indian River Club, and <br />authorize the chairman to sign the contract for construction and <br />warranty and maintenance agreement. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bird, the Board unanimously granted <br />final plat approval to Indian River Club, Plat 11 <br />(Phase I), and approved Contract for Construction of <br />Required Improvements, as recommended by staff. <br />CONTRACT IS ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD <br />4 <br />JUNE 279 1995 <br />
