MEMORANDUM <br />TO: Board of County Commissioners <br />FROM: Dylan Reingold, County Attorney <br />DATE: April 9, 2021 <br />SUBJECT: 16th Street Ballfields Release of Right of Entry and Reservation of Mineral Rights <br />BACKGROUND. <br />As part of the donation of the 16th Street Ballfields from the Jimmy Graves Foundation/Sports Complex to <br />the School District, the School District has requested the County to release any right, reservation, title or <br />interest it may have to any phosphate, metal, mineral, and petroleum interests on the property pursuant to <br />section 270.11, Florida Statutes. In exchange, the School District has agreed that the School District of <br />Indian River County, its heirs, successors and assigns, will not mine for any phosphate, metal, mineral, or <br />petroleum on the property. The County Attorney's Office and the attorneys for the School District have <br />drafted the attached release setting forth this agreement. <br />FUNDING. <br />There is no funding associated with this matter. <br />RECOMMENDATION. <br />The County Attorney's Office recommends that the Board approve the Release of Right of Entry and <br />Reservation of Mineral Rights and authorize the, Chair to execute the Release after final review and <br />approval by the County Attorney. <br />ATTACHMENTS. <br />Draft Release of Right of Entry and Reservation of Mineral Rights. <br />99 <br />
