Bogx 95 652 <br />DESCRIPTION AND CONDITIONS: <br />On July 5, 1994, the Board of County Commissioners granted special <br />exception use approval for an adult congregate living facility. In <br />conjunction with the special exception approval the county also <br />granted major site plan approval for the ACLF project. The site <br />plan proposes the conversion/alteration of an existing single <br />family residence, in conjunction with the construction of a <br />building addition, to establish an adult congregate living facility <br />at 965 Old Dixie Highway S.W. (see attachment #2). The current <br />expiration date of the site plan approval is July 5, 1995. <br />The project applicant has filed a request to extend the site plan <br />approval expiration date and the time limitation of the special <br />exception use approval. According to the applicant, delays in <br />obtaining state permits and licenses necessary to operate the ACLF <br />have delayed project construction. Pursuant to site plan <br />regulations, the request may now be considered by the Board of <br />County Commissioners. <br />ANALYSIS: <br />Although the LDRs have been amended since the time of project <br />review and approval, the members of the Technical Review Committee <br />(TRC) concur that subsequent amendments as applied to the subject <br />project are not significant enough to require any revisions or <br />redesign of the project. All TRC staff members have recently <br />approved the applicant's request for.site plan extension. <br />As allowed under provisions.of the LDRs, Calmes & Peirce, Inc., on <br />behalf of Sylvestro & Sons, Inc., is requesting a full one .year <br />extension of the site plan approval expiration date. Staff has no <br />objections to the Board granting the request since the previously <br />approved site plan substantially conforms to existing LMR <br />requirements. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners approve the <br />request by Sylvestro & Sons, Inc. for a one year extension o.f the <br />conditional site plan approval and the special exception use <br />approval, with all original site plan approval conditions to remain <br />in effect. The new site plan expiration date will be July 5, 1996. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams, the Board unanimously approved a <br />one year extension of the conditional Site Plan <br />Approval and Special Exception Use Approval for <br />Adult Congregate Living Facility for Sylvestro & <br />Sons, Inc., as recommended by staff. <br />JULY 119 1995 8 <br />
