TERMINATION OF STREET LIGHTING AGREEMENT <br /> THIS TERMINATION OF STREET LIGHTING AGREEMENT("Termination") is entered <br /> into as of the 5th day of May , 2021 by and between Indian River County, a political <br /> subdivision of the State of Florida, by and through its Board of County Commissioners, whose address <br /> 1801 27th Street, Vero Beach, Florida, is hereinafter referred to as"County", and Medical Service Center <br /> Property Owners Association. Inc., a Florida Not For Profit, f/k/a Medical Services Center Lot Owners <br /> Association whose address is 3880 30 Square, Vero Beach, FL 32960, hereinafter referred to as <br /> "Association": <br /> RECITALS <br /> WHEREAS, on September 17, 1992, Association executed a Street Lighting Agreement for the <br /> purpose of obtaining the necessary energy and street lighting systems from the City of Vero Beach for <br /> lighting described as follows: <br /> Two (2) 27,500 lumen H.P.S. lights, one (1) 35' concrete pole, and underground <br /> conductors. <br /> WHEREAS,FPL has taken over the City of Vero Beach electric utility;and <br /> WHEREAS,the parties wish to terminate the Street Lighting Agreement so that the Association <br /> can directly contract such services with FPL, <br /> NOW THEREFORE, in consideration of the mutual undertakings herein stated and other good and <br /> valuable consideration, the receipt and adequacy of which are hereby acknowledged, the parties agree, as <br /> follows: <br /> 1. Recitals. The above recitals are true and correct and are incorporated herein. <br /> 2. Termination of Street Lighting Agreement.
