(27) CONSTRUCTION and RENOVATION <br />Construction and renovation projects for a local government's principal <br />Emergency Operations Center (EOC) are allowable under the EMPA Program. The Division <br />must provide written approval prior to the use of any EMPA Program funds for construction or <br />renovation. Requests for EMPA Program funds for construction of an EOC must be <br />accompanied by a justification to their EMPA Grant Manager for review and processing. The <br />above examples are not intended to exclude other construction projects as potentially <br />allowable costs. For example, construction of a facility for the storage of critical emergency <br />supplies, as a Point of Distribution (POD) for emergency distribution, and/or to serve as a <br />staging area for deployment of emergency response resources is potentially an allowable <br />expense. Other construction or renovation projects, such as a secondary or local EOC, will <br />be considered on a case-by-case basis, with advance written approval. <br />(28) REAL PROPERTY <br />Section 287.05805, Florida Statutes, Contract requirement for use of state funds to <br />purchase or improve real property. Each state agency shall include in its standard contract document a <br />requirement that any state funds provided for the purchase of or improvements to real property are <br />contingent upon the contractor or political subdivision granting to the state a security interest in the <br />property at least to the amount of state funds provided for at least 5 years from the date of purchase or <br />the completion of the improvements or as further required by law. <br />(29) CONTRACTING WITH SMALL AND MINORITY BUSINESSES, WOMEN'S BUSINESS <br />ENTERPRISES, AND LABOR SURPLUS AREA FIRMS <br />(a) If the Sub -Recipient, with the funds authorized by this Agreement, seeks to procure <br />goods or services, then, in accordance with 2 C.F.R. §200.321, the Sub -Recipient shall take the following <br />affirmative steps to assure that minority businesses, women's business enterprises, and labor surplus <br />area firms are used whenever possible: <br />Placing qualified small and minority businesses and women's business <br />enterprises on solicitation lists; <br />Assuring that small and minority businesses, and women's business enterprises <br />are solicited whenever they are potential sources; <br />iii. Dividing total requirements, when economically feasible, into smaller tasks or <br />quantities to permit maximum participation by small and minority businesses, and women's <br />business enterprises; <br />20 <br />
