BOARD OF COUNTY COMMISSIONERS <br />PROCLAMATION DECLARING A LOCAL STATE OF EMERGENCY IN <br />INDIAN RIVER COUNTY, FLORIDA, IN CONNECTION WITH COVID-19 <br />WHEREAS, COVID-19 cases in Indian River County are on the rise; and <br />WHEREAS, Indian River County wishes to have the flexibility under section 252.38, Florida <br />Statutes, in addressing the increase in cases, to waive the procedures and formalities otherwise <br />required of Indian River County pertaining to: <br />a. Performance of public work and taking whatever prudent action is necessary to <br />ensure the health, safety, and welfare of the community and the County work force. <br />b. Entering into and modifying existing contracts. <br />c. Incurring obligations. <br />d. Employment of permanent and temporary workers to provide essential services. <br />e. Utilization of volunteer workers. <br />f. Rental of equipment. <br />g. Acquisition and distribution, with or without compensation, of supplies, materi a] s, <br />and facilities. <br />h. Appropriation and expenditure of public funds <br />; and <br />WHEREAS, Indian River County will not infringe the rights or liberties of individuals or <br />businesses within Indian River County; and <br />WHEREAS, pursuant to section 101.10(1) of the Code of Indian River County, and <br />Resolution 2020-104 of the Indian River County Board of County Commissioners, the County <br />Administrator is authorized to declare a local state of emergency upon making a determination that a <br />disaster has occurred or is imminent, requiring immediate and expeditious action; and <br />NOW, THEREFORE, in my capacity as County Administrator, 1 hereby (1) determine that, <br />by reason of COVID-19, the threat of a disaster has occurred, requiring immediate and expeditious <br />action, (2) declare that a local state of emergency exists and continues in all of Indian River County, <br />Florida, effective as of 7:00 a.m., on September 10, <br />Jason E.
