BOARD OF COUNTY COMMISSIONERS <br /> csVER <br /> * * <br /> •41.cnt1vt" <br /> PROCLAMATION DECLARING A LOCAL STATE OF EMERGENCY IN <br /> INDIAN RIVER COUNTY, FLORIDA, IN CONNECTION WITH COVID-19 <br /> WHEREAS,COVID-19 cases in Indian River County are on the rise; and <br /> WHEREAS,Indian River County wishes to have the flexibility under section 252.38,Florida <br /> Statutes, in addressing the increase in cases, to waive the procedures and formalities otherwise <br /> required of Indian River County pertaining to: <br /> a. Performance of public work and taking whatever prudent action is necessary to <br /> ensure the health, safety, and welfare of the community and the County work force. <br /> b. Entering into and modifying existing contracts. <br /> c. Incurring obligations. <br /> d. Employment of permanent and temporary workers to provide essential services. <br /> e. Utilization of volunteer workers. <br /> f. Rental of equipment. <br /> g. Acquisition and distribution,with or without compensation,of supplies,materials, <br /> and facilities. <br /> h. Appropriation and expenditure of public funds <br /> ; and <br /> WHEREAS, Indian River County will not infringe the rights or liberties of individuals or <br /> businesses within Indian River County; and <br /> WHEREAS, pursuant to section 101.10(1) of the Code of Indian River County, and <br /> Resolution 2020-104 of the Indian River County Board of County Commissioners, the County <br /> Administrator is authorized to declare a local state of emergency upon making a determination that a <br /> disaster has occurred or is imminent, requiring immediate and expeditious action; and <br /> NOW,THEREFORE,in my capacity as County Administrator, I hereby(1)determine that, <br /> by reason of COVID-19, the threat of a disaster has occurred, requiring immediate and expeditious <br /> action, (2)declare that a local state of emergency exists and continues in all of Indian River County, <br /> Florida, effective as of 7:00 a.m., on September 17,2021. <br /> , <br /> Jason E.
