BOOK 95 PAGE 7764 <br />contractor, but that it was an additional remedy available to the <br />County to resolve the matter in court. <br />Commissioner Tippin wanted to proceed to court post haste. <br />Commissioner Adams advised that she reluctantly supported the <br />motion, because she felt the arbitration clause should be honored. <br />She agreed a mistake had been made initially by not including <br />arbitration in the architect's contract. <br />THE CHAIRMAN CALLED THE QUESTION and the <br />motion carried unanimously. <br />Chairman Macht, Commissioners Bird and Adams asked that the <br />provisions of the architect's contract be researched and <br />information brought back at the next meeting. <br />Mr. Cummings indicated that he had a copy of the contract and <br />Director Dean advised he had a copy in his office. <br />DEPARTMENT OF ENVIRONMENTAL PROTECTION <br />REGULATORY PROGRAM AND SURVEILLANCE FEES <br />WASTEWATER PERMITS <br />County Attorney Vitunac presented the Board with the first <br />page of a Petition for Informal Administrative Hearing to the State <br />of Florida, Department of Environmental Protection, concerning an <br />invoice submitted to the County relating to the costs of wastewater <br />regulatory and surveillance fees, pursuant to Section 120.57, F.S., <br />and Rule 62-4.052, Florida Administrative Code. <br />Chairman Macht reminded the Board that this matter was before <br />them pursuant to their direction to staff to forward an appeal and <br />follow it up with a lawsuit. <br />County Attorney Vitunac explained that in preparing the <br />petition, it turned out that the actual fee itself was set out in <br />Florida Statutes, so the DEP was following the law precisely. <br />Since it was really a political/ legislative matter, instead of <br />filing a useless challenge, he recommended they authorize <br />correspondence with the Florida Association of Counties (FACo) to <br />challenge the law on a statewide level. He believed Commissioner <br />Adams was a member of that Board and might carry it to FACo. <br />64 <br />July 18, 1995 <br />
