Board of County Commissioners Meeting Minutes - Final July 6, 2021 <br />Recommended Action: Staff recommends Alternative 2, that the Board of County Commissioners <br />direct staff to seek a court order to allow staff access to the subject property to <br />abate the nuisance, authorizing the county's employees, servants, agents or <br />contractors to enter upon the Palmer property located at 1262 15th Avenue at all <br />reasonable times, and take whatever action is necessary to abate the nuisance <br />described in this report, with costs of the abatement to be recorded as a lien <br />against the subject property. <br />Attachments: Staff Report <br />Photos of Subject Property <br />Order Warranty County Abatement <br />County Code Chapter 973 <br />Minutes - May 24 2021 CEB meeting <br />Environmental Planning and Code Enforcement Chief Andrew Sobczak <br />appeared before the Board with a request for authorization to abate a public <br />nuisance at the residential property of Michael and Kelly Palmer. Utilizing a <br />PowerPoint presentation, Chief Sobczak reviewed the Code Enforcement <br />Board's (CEB) actions starting from the initial complaint of junk and trash at <br />1262 15th Avenue in March 2020, through to the March 24, 2021 CEB, order <br />determining the unresolved nuisance warranted county abatement. <br />Under discussion, Chief Sobczak confirmed that the homeowner had not taken <br />steps to resolve the code violations. In response to Board queries, County <br />Attorney Dylan Reingold stated he was hopeful the court would hear the case in <br />the next 30 days, and that the estimated $10,000 cost of abatement would be <br />attached to the home in the form of a lien. Attorney Reingold also noted that <br />following cleanup, the county would seek a court order to prevent accumulation <br />of junk on the property in the future. <br />A motion was made by Commissioner Earman, seconded by Vice Chairman <br />O'Bryan, to approve staff's recommendation.
