When the project is commenced, the contractor must bond <br />to the District as well as to the County to perform construction in <br />—good and workmanlike fashion and according to design. <br />5. The County will agree to undertake with money and <br />equipment to address any problems created in the future by <br />reshaping canal -banks and any cave-ins or bank loss or obstructions <br />to the flow of water by silting or otherwise. This assistance <br />would be in the form of men and personnel or money in removal and <br />hauling away any obstructive material. I understand that the <br />District and the County have always cooperated in this regard. <br />6. The County, during construction, will not impede or <br />obstruct, or permit the contractor or its subcontractors to impede <br />or obstruct, flow in the District Is canal without prior Board <br />approval. <br />7: The •County will reimburse the District for all <br />professional fees associated with 58th Avenue improvements, their <br />design and approval. <br />With best regards, I remain <br />Commissioner Bird asked if we are taking on the responsibility <br />of erosion along the canal bank, and Public Works Director Jim <br />Davis explained that we hope to solve that problem by removing 4-5 <br />feet of that poor soil along the bank and replacing it with sand. <br />We did assume responsibility in that area. <br />Commissioner Bird asked about installing guardrails, and <br />Director Davis advised that we are trying to get away from <br />guardrails because of the difficulty in maintaining the immediate <br />area. <br />At this time there is about 6-8 feet behind the guardrail to <br />the top of the slope of the canal. There is some additional right- <br />of-way east of the canal where the drag line can do major cleaning. <br />There would be 10-12 feet between the canal and the curb. <br />Commissioner Tippin pointed out that is a lot more than we <br />have now, and he believed guardrails are dangerous. <br />Director Davis explained that there is a curb and gutter on <br />the outside of the road that would slow down a vehicle. At the <br />current time, we do show a curb. We have considered eliminating <br />it, but Engineering is considering whether or not the guardrail is <br />an additional safety factor. <br />32 <br />AUGUST 1, 1995 <br />
