NA F� <br />RESOLUTION 95-91 <br />operate a public wastewater system in certain unincorporated areas <br />of Indian River County; and <br />WHEREAS, the City of Vero Beach has relied on this franchise <br />agreement in constructing, maintaining, and operating public <br />wastewater systems in certain unincorporated areas of Indian River <br />County; and <br />WHEREAS, the City of Vero Beach has elected to enter into a <br />reclaimed water program as a method -for the disposal of wastewater <br />effluent; and <br />WHEREAS, the original franchise agreement set forth in <br />Resolution 87-14 does not specifically provide a definition of <br />wastewater to include reclaimed water as a wastewater disposal__ <br />technique; and <br />WHEREAS, the City wishes to expand its reclaimed water <br />distribution system to retail customers in the wastewater franchise <br />area; and <br />WHEREAS, the reuse of reclaimed wastewater is an integral part <br />of wastewater disposal. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, THAT Resolution 87- <br />14 is hereby amended to read as follows: <br />Section 1 - Technical Changes. <br />The section(s) below are amended as follows ( all deletions are <br />depicted by striking over the language, and all additions are <br />depicted by underlining): <br />Section 2 - Amendment. <br />Section 1 of the aforementioned agreement is amended to read <br />as follows: <br />That there is hereby granted to the City of Vero Beach, <br />Florida (herein called "Grantee"), its successors and <br />assigns, the sole and exclusive right, privilege or <br />franchise to construct, maintain, and operate a public <br />wastewater system in, under, upon, over and across the <br />present and future streets, alleys, bridges easements and <br />38 <br />AUGUST 1, 1995 <br />
