Keatirig, eficp <br />Community Devel��opme t Di <br />FROM: Stan Boling,aAIii��CP . <br />Planning Director <br />DATE: July 21, 1995 <br />SUBJECT: Request by Arthur and Denise Ferguson For a Variance From <br />the Subdivision Ordinance Road Paving Requirements <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of August 8, 1995. <br />DESCRIPTION AND CONDITIONS: <br />Arthur and Denise Ferguson have applied for a variance from certain <br />subdivision ordinance road paving requirements as applied to their <br />property at 3100 62nd Avenue. The subject property is a ±1 acre <br />parcel located on the east side of 62nd Avenue, south of 33rd <br />Street, adjacent to the Sunniland Homesites Subdivision (see <br />attachment #2). Their property is located within the Urban Service <br />Area, is zoned RS -3 (Residential Single Family up to 3 units/acre), <br />and is legally described as follows: <br />THE SOUTH 298.95 FEET OF THE EAST 145.71 FEET OF THE WEST <br />5.5 ACRES OF THE WEST 10 ACRES OF THE EAST 20 ACRES OF <br />TRACT 10, SECTION 32, TOWNSHIP 32 SOUTH, RANGE 39 EAST, <br />ACCORDING TO THE PLAT OF LANDS IN INDIAN RIVER FARMS <br />COMPANY SUBDIVISION AS RECORDED IN PLAT BOOK 2 AT PAGE 25 <br />OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. <br />The property fronts 62nd Avenue, an unpaved county local road that <br />lies within a 70' wide right-of-way created by the Sunniland <br />Homesites subdivision plat. The plat was approved in 1956, prior <br />to any county zoning, subdivision, or road paving requirements. <br />The road consists of a gradeable- road base and is the county's <br />maintenance responsibility. Along the west side of 62nd Avenue lie <br />10 lots and a tract created via the Sunniland Homesites plat. The <br />parcels range in size from ±12,150 square feet to ±1.45 acres. On <br />the east side of 62nd Avenue lie 6 metes and bounds parcels created <br />over the years by individual deeds and parcel splits. The parcels <br />range in size from ±10,200 square feet to ±1.12 acres. <br />About 7 years ago, a one time split of a 1.67 acre metes and bounds <br />parcel* located on 62nd Avenue resulted in a .67 -acre parcel and the <br />subject 1 acre parcel. Later, in 1994, the Ferguson's obtained a <br />county single family building permit to construct a residence <br />(their present residence) on the southern half of the subject <br />property.
