'A00F.95 anE876 <br />County Attorney Vitunac advised that he was well aware of the <br />problem; it was covered in the contract. He explained that the <br />City of Sebastian will still be a party and if there is a judgment, <br />it will be against them, but, if it is against us, we are covered <br />in the contract. He added that the contract had been written in <br />the 1980's by then -County Attorney Brandenberg. <br />Director Pinto noted that to facilitate the closing, it was <br />very important to move forward._ He recognized Citrus Utilities' <br />claim, but felt it should not be a stumbling block. <br />Reith Miller, of Sebastian, asked for an explanation of impact <br />fees and hook up charges. <br />Director Pinto explained, in detail, all charges for new and <br />existing customers as well as financing policies and costs. He <br />clarified that existing customers will not pay an impact fee, and <br />that new customers would pay impact fees that are in existence at <br />the time they decide to hook up. <br />Assistant Director Harry Asher gave the current rates for <br />meter installation, customer deposit, impact fees and installation <br />charges. <br />It was determined that no one else wished to be heard and the <br />Chairman closed the public hearing. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams, the Board unanimously <br />approved the purchase of the City of Sebastian <br />Utility System, the operating budget with <br />required improvements and change orders for <br />the construction of the required waterline <br />connections, as recommended in staff's <br />memorandum. <br />Director Pinto thanked the representatives from the City of <br />Sebastian and his staff, particularly Mr. Asher, and recognized the <br />efforts of the Mayor of the City of Sebastian. <br />Chairman Macht invited the Mayor's comments. <br />Mayor Arthur Firtion thanked the Board.
