boa 95 fw 91 27 <br />The Chairman opened the public hearing and asked if anyone <br />wished to be heard.in this matter. <br />Janice Kroegel Timinsky, granddaughter of Paul Kroegel and <br />great granddaughter of George Kroegel who homesteaded this land in <br />1881, stated that this property has been used commercially from <br />1881 through 1991, when the master plan went into effect. Mr. and <br />Mrs. Bunnell were aware of the zoning when they purchased their <br />property. Mrs. Timinsky had a problem with the plans for the <br />property as she was first told the property would be used for a <br />duplex, then was told there would be a retirement or visitor's <br />structure. Mrs. Timinsky then read a letter from her son and <br />daughter-in-law, Tim and Carrie Timinsky, also opposing the <br />Bunnells' request. <br />Warren Dill, attorney for George and Mildred Bunnell, stated <br />that the property will be used for Mr. and Mrs. Bunnell's <br />residence. Mr. and Mrs. Bunnell have legal access to the property <br />and ask that the Board accept staff's recommendation. <br />Lou Riley Fernandez of Melbourne stated that the property <br />always has been commercial. The roadway is private and has never <br />been open to the public. <br />The Chairman asked if anyone else wished to be heard in this <br />matter. There being none, he closed the public hearing. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams, the Board unanimously adopted <br />Ordinance 95-21 amending the zoning ordinance and <br />the accompanying zoning map from CG to OCR for the <br />property located on Lot 2 of the Kroegel Homestead <br />Subdivision, pursuant to staff's recommendations. <br />ORDINANCE NO. 95-21 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE <br />ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM CG TO <br />OCR, FOR THE PROPERTY LOCATED ON LOT 2 OF THE KROEGEL <br />HOMESTEAD SUBDIVISION, AND DESCRIBED HEREIN, AND PROVIDING FOR <br />EFFECTIVE DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the <br />local planning agency on such matters, has held a public hearing <br />and subsequently made a recommendation regarding this rezoning <br />request; and <br />WHEREAS, the Board of County Commissioners of Indian River <br />County, Florida, did publish and send its Notice of Intent to <br />rezone the hereinafter described property; and <br />AUGUST 15, 1995 18 <br />
