RESOLUTION I, `7 ­ "/ / <br />WHEREAS, the Board of County Commissioners of Indian River <br />County, Florida, has found it necessary and does find It neces- <br />sary to acquire land in Indian River County, Florida, for use <br />as a public dump and for future use as a sanitary land fill <br />project; and, <br />WHEREAS, said Board has found and does find that the land <br />hereinafter described is entirely suitable for such purposes <br />and that the purchase of said land is necessary for the fulfill- <br />ment of such purposes and that the purchase price hereinafter <br />named is the fair market value of and a reasonable purchase <br />price for such land; NOW, THEREFORE, <br />BE IT RESOLVED, by the Board of County Commissioners of <br />Indian River County, Florida, that Indian River County purchase <br />from Herschel A. Auxier, individually and as trustee, for a cash <br />price of $31,500.00, the following described land lying and being <br />in Indian River County, Florida: <br />West 10 acres of Tract 9, East 10 acres of Tract 10, <br />West 10 acres of East 20 acres of Tract 10, and East <br />11.11 acres of West 21.11 acres of Tract 10, all it, <br />Section 28, Township 32 South, Range 39 East, ac- <br />cording to the last general plat of lands of the <br />Indian River Farms Company filed in the office of <br />the Clerk of the Circuit Court of St. Lucie County, <br />Florida, in Plat Book 2, page 25; said land now <br />lying and being in Indian River County, Florida. <br />Subject to all. easements, rights-of-way, restrictions <br />and reservations of record. <br />BE IT FURTHER RESOLVED, that all ad valorem and other taxes <br />on said land for 1962 be prorated as of the date of delivery of <br />the deed and the payment of the purchase price. <br />BE IT FURTHER RESOLVED, that no part of such purchase price be <br />paid and that delivery of a deed to said land not be accepted until <br />title evidence in the form of abstract of title showing good and <br />marketable title vested in said Herschel A. Auxier has been de- <br />livered to Indian River County, and until such title has been <br />approved by the County Attorney. <br />Al Webber presented for Attorney Charles Herring the following <br />Resolution on Oslo Road right-of-way. Motion was made by Commis- <br />sioner Macdonald, seconded by Commissioner McCullers and unanimously <br />carried, that the same be adopted and that $860.00 is authorized to <br />be paid into the Registry of the Court Fund for Condemnation Suit No. <br />5760. <br />
