FIRST AMENDMENT TO AGREEMENT FOR AS NEEDED MOTOR AND PUMP REPAIR SERVICES BETWEEN <br />FLORIDA ARMATURE WORKS AND INDIAN RIVER COUNTY, FLORIDA <br />This is the First Amendment to the Agreement for as Needed Motor and Pump Repair Services dated August <br />13, 2019, between Florida Armature Works. Inc. (CONTRACTOR) and Indian River County, a political <br />subdivision of the State of Florida, 180127 th Street, Vero Beach, Florida, 32960 (COUNTY). <br />WHEREAS, the Parties entered into an Agreement for As Needed Motor and Pump Repair Services <br />dated August 13, 2019; and <br />WHEREAS, the parties desire to amend Article 7 — Contractor's Representations to include e -Verify <br />requirements; <br />WHERFAS, the parties desire to amend. Artirle 9 — Miscellaneous to include Co -Operative Purchasing; <br />NOW, THEREFORE, in consideration of the following mutual covenants and agreements Indian River <br />County, Florida and CONSULTANT agree as follows: <br />The Agreement for As Needed Motor and Pump Repair Services dated August 13, 2019, is amended as <br />follows: <br />Article 7 — Contractor's Representations — add the following item: <br />7.01 (J) Contractor is registered with and will use the Department of Homeland Security's <br />E -Verify system (www.e-verify.gov) to confirm the employment eligibility of all newly hired <br />employees for the duration of this agreement, as required by Section 448.095, F.S. Contractor is also <br />responsible for obtaining proof of E -Verify registration and compliance for all subcontractors. <br />Article 9 — Miscellaneous — add the following: <br />9.07 COUNTY and CONTRACTOR acknowledge the right of other Florida Governmental agencies to <br />utilize this agreement, when appropriate. CONTRACTOR and the requesting Governmental agency, <br />apart from Indian River County, shail itandie any such purchases separately. Further, COUNIY assumes <br />no liability for materials or services ordered by any other Governmental agency by virtue of this <br />agreement. <br />Except as supplemented herein, the terms and conditions of the Agreement shall remain in full force <br />and effect. To the extent of any conflict between the terms of this Amendment and the terms of the <br />Agreement, the terms of this Amendment shall control. <br />This Amendment. No. 1, regardless of where executed, shall be governed by and construed according to <br />the laws of the State of Florida. <br />
