LICENSE AGREEMENT <br />This license agreement ("License Agreement") entered into on this day of <br />2021 by the BOARD OF COUNTY COMMIS <br />NE OF <br />INDIAN RIVER COUNTY, FLORIDA, a political subdivision of the State Florida, 1801 <br />27th Street, Vero Beach, Florida 32960, hereinafter referred to as "IRC," nd Indian River <br />Sports Complex INC, 3285 3rd Place Vero Beach, FL 32968, herei fter referred to as <br />"IRSC," in consideration of the mutual promises and agreements "/ <br />forth below, hereby <br />agree as follows: <br />WITNESSETH: ! <br />1. PROPERTY AND TERM. IRC hereby issues a licen54 to the IRSC for the use of the <br />Helen Hanson Park at 8020 129th Court, /fterwith <br />Flori 32958, in the County of Indian <br />River, Florida, more particularly described : <br />The youth baseball field, bd lighting, and restrooms. <br />The term of the License shall begin approved by the Board of County <br />Commissioners and end three (3) years twith an option to renew for two, three- <br />year terms upon mutual agreement of bo. The' County's right of entry onto the <br />property shall begin upon termination of thiAgreement. <br />1.1 Extension of License. T%is License shall not be extended beyond the stated <br />term unless agreed upon in writing, 3 days before expiration of this License. <br />1.2 Termination of Li nse bv IRSC may opt -out of this License anytime during <br />the license period by providing/written notice to IRC. This License shall terminate if the <br />IRSC no longer occupies or us the licensed premises. <br />1.3 License Fe.6. Provided IRSC performs all terms and conditions of this <br />License Agreement, IRXC shall not be required to pay a fee for use of premises. <br />2. USE OF PRIZMISES. During the term of this License, the IRSC shall use the <br />licensed premises or IRSC, youth baseball programming, clinics and youth enrichment <br />programming. I C shall not use the premises, or any part thereof, or permit the same to <br />be used for an illegal, immoral, or improper purposes; not to make, or permit to be made, <br />any disturba e, noise, or annoyance whatsoever detrimental to the premises or the <br />comfort and eace of the inhabitants of the vicinity of the premises. Members and guests of <br />IRSC shal not use tobacco or have alcohol on the premises. IRC will permit access to the <br />facility t IRSC, however, that access is not intended ;to be exclusive access. IRSC <br />recogn. es that the Park is open to the public and other than the times IRSC is using the <br />ball fi Id for scheduled activities, the Park and ball field are open and available for use by <br />the ublic. <br />59 <br />
