Macdonald, secondedbyComissioner`McCullers and unanimously carried,
<br />that the Board accept the proposition of Mr. Ryall with the understanding
<br />that there will be no restrictions on the use of the road by the public,
<br />that $1,500.00 will, be paid by the interested property owners as part of
<br />the cost and the property owners are to -maintain the,road at their ex-
<br />pense.
<br />The County Attorney reported that the final hearing on the case of
<br />Ruth Johnson, Palmist, had been heard and that the Court ruled that her
<br />Petition could not legally be denied. Upon Motion made by Commissioner
<br />Hamilton, seconded by Commissioner McCullers and unanimously carried, the
<br />following Resolution was adopted.
<br />RESOLUTION
<br />WHEREAS, the Circuit Court of the Ninth Judicial Circuit in
<br />and for Indian River County, Florida, in that certain case entitled
<br />STATE OF FLORIDA, ex rel, RUTH M. JOHNSON, Relator, vs. ROBERT W.
<br />GRAVES, as Chairman, J. J. P. HAMILTON, DONALD McDONALD, D. B.
<br />McCULLERS and B. Q. WADDELL, as and constituting the Board of
<br />County Commissioners of Indian River County, Florida, and J.
<br />DOUGLAS BAKER, as the Clerk thereof, Respondents, did on April
<br />23, 1962, issue its peremptory writ of mandamus commanding the
<br />Respondents named above forthwith to convene as a Board of County
<br />Commissioners of Indian River County, Florida, and to issue to the
<br />Relator, Ruth M. Johnson, a permit, permitting the Relator to have
<br />issued to her, a license to engage in the occupation of palmist in
<br />Indian River County, Florida, in accordance with the provisions of
<br />Section 205.411, Florida Statutes Annotated; NOW, THEREFORE,
<br />BE IT RESOLVED by the Board of County Commissioners of Indian
<br />River County, Florida, that Ruth M. Johnson is entitled, under the
<br />foregoing peremptory writ of mandamus to the permit mentioned
<br />therein; and,
<br />BE IT FURTHER RESOLVED, that the Chairman of the Board of
<br />County Commissioners of Indian River County, Florida, be and be
<br />is herewith and hereby authorized and directed to make, execute
<br />and deliver such permit in the name of this Board.
