as provided therein, as follows: <br />F <br />On or about the first day of each month ninety per cent <br />,(90%) of the value, based on the Contract prices of labor and. <br />(materials incorporated in the work and of materials s4itably <br />stored at the site thereof or at some other location agreed upon <br />in writing by the parties up to the previous day of that month, <br />as estimated by the Architect, less the aggregate of previous pay- <br />ments; and upon substantial completion of the entire work, a sum <br />sufficient to increase the total payments to ninety per cent (90%) <br />of the Contract price. <br />ARTICLE 5. ACCEPTANCE AND FINAL PAYMENT. <br />Upon receipt of written notice from the Contractor that <br />the work is ready for final inspection and acceptance, the Archi- <br />tect shall promptly make such inspection and, if he finds the work <br />acceptable under the Contract and the Contract fully performed, <br />he shall promptly issue a final certificate, over his signature, <br />stating that the work provided for in this Contract has been com- <br />pleted and is accepted by him under the terms and conditions there <br />of and that the entire balance found to be due the Contractor, and <br />noted in said final certificate, is due and payable. However, the <br />entire balance found to be due the Contractor, and noted in said <br />final certificate, shall not be paid until the work shall have <br />inspected and accepted by the Board of County Commissioners of <br />Indian River County, Florida, and, anything herein to the contrary <br />notwithstanding, not less than ten per cent (10%) of the contract <br />sum shall remain unpaid until such inspection and acceptance of <br />the work by the Board of County Commissioners of Indian River <br />County, Florida, PROVIDED, HOWEVER, that such inspection by said <br />Board shall be completed within thirty (30) days after the Archi- <br />tect delivers said final certificate to said Board and, PROVIDED, <br />2. <br />LAW OFFICE JOHN R.
