Board of County Commissioners Meeting Minutes - Final November 9, 2021 <br />County Attorney Dylan Reingold reported on Senate Bill (SB) 896, enacted during <br />the 2021 Legislative session, which required solar facilities to be a permitted use in <br />all agricultural zoning districts in unincorporated areas. He advised that the <br />County currently allowed solar facilities as a special exception use, and that he <br />would need the Board's approval to return with an Ordinance which would bring <br />the County into compliance with SB 896. <br />Chairman Flescher noted that the latest Florida Power and Light (FPL) solar field <br />required only approval from the Planning and Zoning Commission due to this new <br />legislation. <br />A motion was made by Vice Chairman O'Bryan, seconded by Chairman Flescher, to <br />approve staffs recommendation. The motion carried by the following vote: <br />Aye: 5- Chairman Flescher, Vice Chairman O'Bryan, Commissioner Adams, Commissioner <br />Earman, and Commissioner Moss <br />13.13. 21-1043 Chapter 164 Mediation Update <br />Attachments: Staff Report <br />10.25.21 Ltr fm COVB - Com Flescher <br />10.27.21 Emal fm Dylan Reingold to John Turner <br />County Attorney Dylan Reingold discussed the latest developments in the ongoing <br />dispute resolution process with the City of Vero Beach (City) regarding provision of <br />water and sewer services to Indian River Shores. In a letter to the County dated <br />October 25, 2021, the City sent notice that it wanted to move to the mediation <br />phase of the resolution process. <br />Attorney Reingold advised the Board that based on his interpretation of the State <br />statutes, the decision to move forward with mediation should be discussed during a <br />public meeting rather than in a letter. He believed a public meeting also would <br />allow clarification of the County's position, and he recommended scheduling <br />another public meeting. <br />Board discussion ensued with support expressed for Attorney Reingold's suggestion <br />for an additional meeting with the City. <br />A motion was made by Commissioner Earman, seconded by Chairman Flescher, to <br />approve the County Attorney's recommendation to schedule an additional meeting <br />with the City of Vero Beach.
