19.02 More than one Bid for the same Work from an individual or entity under the same or <br />different names will not be considered. Reasonable grounds for believing that any Bidder has an <br />interest in more than one Bid for the Work may be cause for disqualification of that Bidder and the <br />rejection of all Bids in which that Bidder has an interest. <br />19.03 In evaluating Bids, OWNER will consider whether or not the Bids comply with the <br />prescribed requirements, and such alternates, unit prices and other data, as may be requested in <br />the Bid Form or prior to the Notice of Award. It is the OWNER's intent to accept alternates (if any <br />are accepted) in the order in which they are listed on the Bid form, but OWNER may accept them <br />in any order or combination. <br />19.04 In evaluating Bidders, OWNER will consider the qualifications of Bidders and may <br />consider the qualifications and experience of Subcontractors, Suppliers, and other individuals or <br />entities proposed for those portions of the Work for which the identity of Subcontractors, <br />Suppliers, and other individuals or entities must be submitted as provided in the Supplementary <br />Conditions. <br />19.05 OWNER may conduct such investigations as OWNER deems necessary to establish <br />the responsibility, qualifications, and financial ability of Bidders, proposed Subcontractors, <br />Suppliers, individuals, or entities to perform the Work in accordance with the Contract Documents. <br />19.06 If the Contract is to be awarded, OWNER will award the Contract to the Bidder whose <br />Bid is in the best interests of the Project. <br />19.07 OWNER has no local ordinance or preferences, as set forth in FS 255.0991 (2) in <br />place, therefore no preference prohibited by that section will be considered in the acceptance, <br />review or award of this bid. <br />19.08 Any actual or prospective bidder or proposer who is aggrieved in connection with the <br />bidding and/or selection process may protest to the OWNER's Purchasing Manager. The <br />protest shall be submitted in writing to the Purchasing Manager within seven (7) calendar days <br />after the bidder or proposer knows or should have known of the facts giving rise to the protest. <br />19.09 CONTRACTOR certifies that it and its related entities as defined by Florida law are <br />not on the Scrutinized Companies that Boycott Israel List, created pursuant to s. 215.4725 of <br />the Florida Statutes, and are not engaged in a boycott of Israel. In addition, if this agreement is <br />for goods or services of one million dollars or more, CONTRACTOR certifies that it and its <br />related entities as defined above by Florida law are not on the Scrutinized Companies with <br />Activities in Sudan List or the Scrutinized Companies with Activities in the Iran Petroleum <br />Energy Sector List, created pursuant to Section 215.473 of the Florida Statutes and are not <br />engaged in business operations in Cuba or Syria. <br />OWNER may terminate this Contract if CONTRACTOR is found to have submitted a false <br />certification as provided under section 287.135(5), Florida Statutes, been placed on the <br />Scrutinized Companies with Activities in Sudan List or the Scrutinized Companies with Activities <br />in the Iran Petroleum Energy Sector List, or been engaged in business operations in Cuba or <br />Syria, as defined by section 287.135, Florida Statutes. <br />OWNER may terminate this Contract if CONTRACTOR, including all wholly owned subsidiaries, <br />majority-owned subsidiaries, and parent companies, that exist for the purpose of making profit, <br />is found to have been placed on the Scrutinized Companies that Boycott Israel List or is <br />engaged in a boycott of Israel as set forth in section 215.4725, Florida Statutes. <br />00200 - Instructions to Bidders REV 10-18.doc <br />00200 - 10 <br />F:\Public Works\ENGINEERING DIVISION PROJECTS\1638 6th Avenue US -1 to 21st Street Resurfacing (SCOP)\1-Admin\Bids\Bid Documents\Master Contract <br />Documents\00200 - Instructions to Bidders REV 10-18.doc <br />
