/®A1 <br />MEMORANDUM <br />TO: Board of County Commissioners <br />FROM: Dylan Reingold, County Attorney <br />DATE: December 16, 2021 <br />SUBJECT: Amendments to Chapter 304 (Life Support and Wheelchair Services) of the Indian River <br />Code of Ordinances - LEGISLATIVE <br />Pursuant to Chapter 304 (Life Support and Wheelchair Services) of the Indian River Code of Ordinances <br />(the "Code"), Indian River County issues certificates of public convenience and necessity for life support <br />and wheelchair vehicle services in Indian River County. Certificates of public convenience and necessity <br />for life support services are issued for a) governmental entities that use advanced life support vehicles to <br />conduct a pre -hospital EMS advanced life support or basic life support service, b) businesses, agencies <br />and hospitals that use ambulances to conduct a non -emergency interfacility medical transport or transfer <br />service at the ALS or BLS level, c) businesses, agencies, hospitals, and governmental entities who use <br />ambulances to conduct non -emergency interfacility medical transport or transfer services requiring on- <br />board clinical capabilities which may exceed those of a conventionally equipped and staffed advanced life <br />support ambulance and which originate in the county, under a physician's order, and d) businesses and <br />agencies that use ambulances based outside the county to provide specific non -emergency medical <br />services as identified on the certificate and limited to transports out of the county. <br />Under Chapter 304 of the Code, Indian River County also issues certificates of public convenience and <br />necessity for wheelchair vehicle services. These are E or E1 certificates issued under Part II of Chapter <br />304 of the Code. On October 12, 2021, the Indian River County Board of County Commissioners <br />("Board") authorized the County staff and the County Attorney's Office to draft an ordinance deleting <br />Part II of Chapter 304 from the Code, in addition to making technical changes to Part I of Chapter 304 of <br />the Code. <br />County staff no longer believes that it is necessary to be involved in regulating the number of businesses <br />offering wheelchair vehicle services in Indian River County. County staff believes that this is better left to <br />being determined by the market need. Thus, County staff recommends that the Board approve the draft <br />ordinance. <br />71 <br />
