<br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
<br />INDIAN RIVER COUNTY, FLORIDA, PROVIDING FOR THE CLOSING,,
<br />ABANDONMENT AND VACATION OF ALL OF AN UNNAMED ROAD
<br />RIGHT-OF-WAY LYING IN GOVERNMENT LOT 4, SECTION 23,
<br />TOWNSHIP 31, RANGE 39 EAST RUNNING ROUGHLY PERPENDICULAR
<br />TO A.I.A.
<br />WHEREAS, on November 28, 1988, the County received a duly
<br />executed and documented petition from Bruce Barkett, Esquire of
<br />Vero Beach, Florida, requesting the County to close, vacate,
<br />abandon and disclaim any right, title and interest of the County
<br />and the public in and to all of an unnamed road right-of-way lying
<br />in Government Lot 4, Section 23, Township 31, Range 39 east
<br />running westerly from A.I.A., lying and being in Indian River
<br />County, Florida.
<br />WHEREAS, in accordance with Florida Statutes §336.10 notice
<br />of a public hearing to consider said petition has been duly
<br />published= and
<br />WHEREAS, after consideration of the petition, supporting
<br />documents, staff investigation and report, and testimony of all
<br />those interested and present, the Board finds that said
<br />right-of-way is not a state or federal highway, nor located within
<br />any municipality, nor is said right -of. -way necessary for continu-
<br />ity of the County's street and thoroughfare network, nor access to
<br />any given private property.
<br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMIS-
<br />SIONERS OF INDIAN RIVER COUNTY, FLORIDA that:
<br />1. All right, title and interest of the County and the public in
<br />and to that certain right-of-way being known more particularly
<br />described as:
<br />BEING A ROAD RIGHT-OF-WAY LYING IN A PORTION OF GOVERNMENT
<br />LOT 4, SECTION 23, TOWNSHIP 31 SOUTH, RANGE 39 EAST, INDIAN
<br />RIVER COUNTY, FLORIDA, THE BOUNDARY OF SAID ROAD RIGHT-OF-WAY
<br />BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
<br />FROM THE SOUTHWEST CORNER OF SAID GOVERNMENT LOT 4, RUN NORTH
<br />00006136" EAST, ALONG THE WEST LINE OF GOVERNMENT LOT 4,
<br />502.93 FEET TO AN iaON PIPE FOR THE POINT OF BEGINNING OF THE
<br />RIGHT-OF-WAY TO BE DESCRIBED HEREIN; THENCE RUN SOUTH
<br />89004143" EAST, ALONG THE SOUTH LINE. OF THE NORTH 831.81 FEET
<br />OF SAID GOVERNMENT LOT 4, 1034.04 FEET, MORE OF LESS, TO A
<br />CONCRETE MONUMENT ON THE WEST RIGHT-OF-WAY LINE OF STATE ROAD
<br />A.I.A.; THENCE RUN NORTH 24°24'58" WEST, ALONG SAID STATE
<br />ROAD A.I.A., RUN SOUTHWESTERLY ON A CURVE TO THE RIGHT,
<br />HAVING A RADIUS OF 25.00 FEET, A CENTRAL ANGEL OF 115°20'15",
<br />AND AN ARC DISTANCE OF 50.32 FEET: THENCE RUN NORTH 89°04143"
<br />WEST, 966.98 FEET MORE OR LESS, TO A POINT ON THE WEST LINE
<br />OF SAID GOVERNMENT LOT 4; THENCE RUN SOUTH 00°06'36" WEST,
<br />60.00 FEET TO THE POINT OF BEGINNING. CONTAINING 1.413
<br />ACRES, MORE OR LESS.
<br />is hereby forever close, abandoned, vacated, surrendered, discon-
<br />tinued, remissed and released.
<br />2. Notice of the adoption of this resolution shall be forthwith
<br />published once within THIRTY (30) days from the date of adoption
<br />hereof; and
<br />3 The Clerk is hereby directed to record this resolution
<br />together with the proofs of publication required by Florida
<br />Statutes 5336.10 in the Official Record Books of Indian River
<br />County without undue delay.
