9/89(WGCORD)LEt".AL(WGC/nhm) <br />61 076 <br />RESOLUTION 89-_127 <br />A RESOLUTION OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLORIDA, VACATING, IN PART, THE PLAT OF <br />NON-EXCLUSIVE EASEMENTS PERTAINING -T -U: -' <br />TIMBER RIDGE VILLAGE 11, A CONDOMINIUM, <br />WHEREAS, Non-Ewc.b4-f`ve Easements pertaining to <br />Timber Ridge Village 11, a Condominium, have been platted <br />pursuant to Florida Statute Chapter 177 as laid out and <br />recorded in Plat Book 12, Page 51 and Page 51A, Public <br />Records of Indian River County, Florida, and <br />WHEREAS, the fee simple owners of that portion of <br />the Non -Exclusive Easements pertaining to Timber Ridge <br />Village 11, a Condominium have applied for vacation of a <br />portion of said plat, returning that portion to acreage, and <br />WHEREAS, the portion of the plat to be vacated <br />consists of a portion of Tract B of the Non -Exclusive <br />Easements pertaining to Timber Ridge Village 11, a <br />Condominium as described and depicted on the attached <br />Exhibits "A" and "B", and <br />WHEREAS, it has been shown that the vacation will <br />i <br />not affect the ownership or right of convenient access of <br />(� <br />persons owr-Eng other parts of the development, and <br />WHEREAS, notice of the intention to apply to the <br />Board of County Commissioners of Indian River County to <br />vacate a portion of such plat has been published as a legal <br />notice in a newspaper of general circulation in Indian River <br />County in not less than two weekly issues of said paper, and <br />WHEREAS, proof of said publication of the petition <br />for vacation is attached hereto, and <br />WHEREAS, a certificate from the Tax Collector <br />showing that all state and county taxes have been paid on <br />the property is attached hereto, <br />NOW, THEREFORE, BE 1T RESOLVED by the Board of <br />County Commissioners of Indian River County, Florida, that: <br />ISoc.
