• 10/23/89(SPB02)LECAL(SPB/bk) 1.1 4 COUNTY DEED THIS DEED, made this 17th day of October, 1989, by INDIAN RIVER COUNTY, FLORIDA, a political subdivision of the State of Florida, party of the first part (hereinafter COUNTY), and THE CHILDREN'S HOME SOCIETY OF FLORIDA, a not-for-profit corporation organized and existing under the laws of the State of Florida, party of the second part (hereinafter HOME), WITNESSETH that the said party of the first part, for and In consideration of the sum of TWENTY-FIVE THOUSAND DOLLARS ($25,000.00) to it in hand paid by the party of the second part, receipt whereof Is hereby acknowledged, has granted, bargained and sold to the party of the second part, Its heirs and assigns forever, the following described land lying and being In Indian River County, Floriclat LEGAL DESCRIPTION ATTACHED HERETO AND INCORPORATED HEREIN AS "EXHIBIT All. SUCH CONVEYANCE BEING CONDITIONED UPON THE REQUIREMENT that the HOME shall, within one (1 ) year from the date of this deed, put Into, operation upon the real property conveyed by this deed thereafter and maintain In operation, a shelter and counseling service for runaway children, which operation shall be recognized as promoting a public purpose in Indian River County, if said operation has not commenced within one (1) year or if said operation, once commenced, shall cease for a period longer than three (3) months the COUNTY shall adopt a resolution so stating the FAILURE OF THE CONDITION, and upon recording of the resolution, THE TITLE, USE, AND INTEREST IN THE PROPERTY SHALL REVERT TO COUNTY, with all improvements becoming the property of COUNTY, or, at the COUNTY's option, the HOME may be required to remove all of the Improvements and return the property to the COUNTY in Its present condition, and the effect of this deed shall be voided, and the COUNTY will return the sum of TWENTY-FIVE THOUSAND DOLLARS (#25,000.00) to the HOME within ten (10) days thereafter.
