7. H.Margo Stanford Developer 's AgreementAmendment - 9th Place and 9th Street Water Main The Roard reviewed a Memorandum of October 3 , 2001 : 0 rX , DATE : OCTOBER 03 , 2001 T0 : JANLES E . AND STAFFED ENVIRONMENTAL ENGINEER BY : INDIAN RIVER COUNTY UTILITIES SUBJECT : 9T" PLACE AND 9T" STREET WATER MAIN DEVELOPER ' S AGREEMENT ANIENDMENT BACKGROUND On March 20, 2001 , the Board of County Commissioners authorized professional services for the design, permitting and construction services with Margo Stanford. (See Attachment-A) The subject Developer' s Agreement was initiated to abandon the 2" water mains located in easements behind properties located on 9h Place and 9`s Street. The Utilities Department has since recognized the need for abandonment of a similar 2" water main located one block south, behind the properties located on the north side of 8 `s Place. The Utilities Department recommends that this water main be replaced with a 6" water main in the 8 's Place right-of-way as was done with the other 2 " water mains. This replacement will provide both fire flow and better access for meter readers. Note that this is the last remaining 2 " water main located in the general vicinity . See Attachment B for a layout of the proposed additions. ANALYSIS The original Developer ' s Ageement between Margo Stanford and Indian River County was for 66 , 869 . 10 . The additional costs requested within the Amendment equal $ 50 , 559 . 00 . The total amended contract, inclusive of the original contract and the amendment, will equal $ 117 ,428 . 10 . Margo Stanford has been paid $48 , 530 . 00 from the original contract amount of $66 , 869 . 10 for utility work performed to date . The work performed to date includes design, permitting and construction services . The remainder of the project, inclusive of 8 `h Place , if approved, is anticipated to be constructed within the next couple of months . At that time, the remainder of the fees , inclusive of the Amendment, can be paid. RECONIAtENDATION The staff of the Department of Utility Services recommends that the Board of County Commissioners approve the attached request for an Amendment of the subject Developer ' s Agreement.
