<br />CARL) program. On April 3 , 2001 , the Board approved an amended Option Agreement for County sale
<br />of the Fischer-St. Sebastian River property to the Board of Trustees of the Internal Improvement Trust
<br />Fund (BTIITF) at a price of $476 ,240 , and authorized staff to take steps as necessary to close the sale .
<br />Since that time, county staff has coordinated with staff of the Division of State Lands (DSL) to complete
<br />due diligence ' activities (i . e . , survey, environmental site assessment, title insurance) to facilitate closing
<br />of sale of the property to the State . During that process , it was determined that Fischer Lake Island
<br />Subdivision, a residential development adjacent to the conservation area on the west-side of the St.
<br />Sebastian River, has two drainage outfalls leading into the conservation area . Fischer Lake Island is a
<br />private subdivision located in the City of Sebastian that was approved under the City ' s regulatory
<br />purview . State staff has concluded that the drainage outfalls are acceptable , provided the County
<br />dedicates two drainage easements on the conservation area property to the Fischer Lake Island Property
<br />Owner ' s Association (POA) prior to selling the property to the State .
<br />As such, the attached drainage easement dedication document is presented for the Board ' s approval
<br />consideration .
<br />ANALYSIS
<br />The two drainage outfalls into the conservation area follow drainage- ways that existed prior to
<br />development of Fischer Lake Island Subdivision . Notwithstanding, the developer of Fischer Lake Island
<br />Henry Fischer and Sons) has agreed to modify the outfalls to be emergency overflow outfalls , such that
<br />drainage into the conservation area will occur only in rare storm events . The proposed drainage
<br />easements are limited in scope, and will allow areas immediately adjacent to the outfalls to be
<br />periodically maintained by the Fischer Lake Island POA, as necessary . County and State staff have 11
<br />concluded that the outfalls and easement maintenance areas will have no adverse impacts to resources of
<br />the conservation area or to water quality in the St. Sebastian River.
<br />The County has essentially two alternatives . The first alternative is for the County not to dedicate the
<br />easements, which will stall and possibly prevent closing with the State . The second alternative is for the
<br />County to approve the easements , proceed with closing of the sale to the State , and receive the cost-share
<br />reimbursement .
<br />RECOMMENDATION :1 .
<br />Staff recommends that the Board of County Commissioners approve the attached easement dedication
<br />document and authorize the Board Chairman to execute the document. Moreover, staff recommends that
<br />the Board authorize county staff to take actions as necessary to finalize closing of the sale .
