SMITH, CLERK <br />(b) Notwithstanding the foregoing, the TENANT shall be solely responsible for <br />and indemnify LANDLORD for all costs and expenses including, but not limited to, <br />remediation, fines, and attorney's fees through trial and appeal, that arise in any manner <br />out of environmental contamination caused by the TENANT, the TENANT'S agents, <br />employees, contractors, or invitees during any prior or current tenancy or occupancy of <br />the Leased Premises or any portion thereof. <br />(c) The parties' responsibilities, obligations, and liabilities pursuant to this <br />Lease Agreement shall survive the expiration or early termination of the Lease <br />Agreement or any renewal term. <br />(d) Nothing in the Lease Agreement shall be deemed to be a waiver of the <br />LANDLORD'S right to take action against responsible parties for remediation of, or <br />payment for, environmental contamination on the Leased Premises, nor be deemed to <br />be an assumption by the LANDLORD of the responsibility for such remediation or <br />payment, except as may be imposed on the LANDLORD as a matter of law. <br />(e) The TENANT acknowledges that remediation steps taken to correct any <br />environmental contamination may extend over a number of years and may cause <br />inconvenience and business interruption to the TENANT. The LANDLORD shall not be <br />liable to the TENANT in any manner for such inconvenience and disruption. <br />(f) Except as properly permitted under federal, state and local laws, rules, <br />and regulations, TENANT shall not conduct nor permit or authorize any other person or <br />entity to engage in the generation, storage, treatment, or disposal of any hazardous <br />materials (as defined under federal, state, and local environmental laws), on or in any <br />location that might adversely affect or contaminate the Leased Premises.
