LPM <br />RESOLUTION NO. 68-30 <br />The Board of County Commissioners of Indian River C:;ounty, <br />Florida, resolves: <br />1, 'That this Board is and has been for a long period of time <br />greatly concerned with respect to the sale of the bottom lands lying within the <br />tl <br />area of the public navigable waters of this state which are held in trust for the <br />benefit of the people of the State of Florida as the practice has existed foi. <br />many years and it hereby expresses itsdisapprovalof the indiscriminate sale: <br />of any of such lands and hereby expresses the opinion that no lands Iying below_ <br />the ordinary high water mark of the navigable waters of the Statc of Florida <br />should be sold excepting; only when it is evident and apparent that a sale of a <br />part thereof should be made to either (a) permit the filling of the portions <br />thereof constituting; marsh lands as distinguished from lands lying; under the <br />open waters and even then not beyond the line of vegetation; or (b) when dont <br />to settle and confirm uncertain cluestions of the boundary of ownership between <br />the private upland owner and the public lands; or (c) to permit the elimination <br />of minor irregularities in the shore line, provided, however, that shore in- <br />dentations should not be permitted to be; straightened out except if the:: sane: <br />may be done by following cords in a straight 1111c from the outermost point to <br />the inner-most point, provided the cord does not have a length of more than <br />300 feet, <br />2, 'Phis Board does herewith express its intent to oppose the sale <br />of any of the sovereign lands of the: State of Florida not clearly falling within <br />the exceptions bereinbefore enumerated and does herewith respectfully request <br />the Trustees of the Internal hnprovenient Fund of the State. of Florida to adopt <br />a like policy, which policy would in the opinion of this .Board permit the <br />development of marsh and swamp lands and at the same time preserve the <br />open waters and the bottom lands of the open waters for the benefit of tine <br />people of this state . <br />3.
