O'Brien - Assistant County AttorneyCV1"b <br />DATE: September 11, 1995 <br />SUBJECT: PUBLIC HEARING - SEPTEMBER 269 1995 <br />AMENDMENT TO SECTION 400.019 INDIAN RIVER <br />COUNTY CODE <br />On September 5, 1995 the Board of County Commissioners authorized <br />advertisement of the attached ordinance. It provides for the <br />suspension of contractors certificate of competency when outstanding <br />fines exist against the contractor. <br />Recommendation: <br />Staff recommends approval of the ordinance. <br />Deputy County Attorney Will Collins explained that at the <br />present time there are no penalties available to enforce fines <br />against contractors other than bringing them before the Code <br />Enforcement Board. They are able to renew licenses without paying <br />any outstanding fines. <br />Building Director Esther Rhymer advised the County presently <br />has in excess of $5,000 outstanding in fines and felt this <br />ordinance will assist in collecting those funds. <br />The Chairman opened the public hearing and asked if anyone <br />wished to be heard in this matter. There being none, he closed the <br />public hearing. <br />ON MOTION by Commissioner Adams, SECONDED by <br />Commissioner Bird, the Board by a 4-0 vote <br />(Commissioner Eggert being absent) unanimously <br />adopted Ordinance 95-23 providing for the suspension <br />of contractors certificate of competency when <br />outstanding fines exist against the contractor. <br />SEPTEMBER 26, 1995 14 <br />
